THINSATIONS REUNITED CONTEST 2011
Official Contest Rules
1) CONTEST PERIOD: This contest begins on February 22, 2011 at 5:00pm Eastern Time (ET) and closes on April 6, 2011 at 11:59pm Eastern Time (ET), the CONTEST CLOSING DATE.
2) HOW TO ENTER: NO PURCHASE NECESSARY. In order to be eligible to win the first prize, log on to contest.thinsations.ca and follow the on-screen instructions to enter. To be entered into the contest, you must do the following steps:
You must submit an essay in 500 words or less, sharing your story on why you and your friends should be reunited.
Only one story can be completed per group of friends, however, multiple groups of friends can be created. i.e. If the entrant wishes to create two separate groups of friends, two separate essays can therefore be submitted.
Once your essay is completed, click “Submit” and you will be automatically entered into the contest.
Each essay must be original, has not been previously published or won any other prize/award, not infringe copyright or other intellectual property rights of any other party, and must be suitable for publication (i.e. must not be obscene or indecent.)
Entries are limited to one (1) entry per person, per day. Entries are also limited to one entry per e-mail address or Facebook user login. Entries will also only appear on the contest website for a period of 10 days. After which point, they will expire.
All essays shall become the property of Kraft Canada Inc. (“Sponsor”) and will not be returned to entrants. The entrant irrevocably assigns and transfers to the Sponsor any and all rights, title, and interest in the essay including, without limitation, all copyright. Sponsor shall have the right to edit or modify essay for use in perpetuity.
INSTANT WIN: An instant win for this contest is for the second prizes only. In order to be eligible for a chance to instantly win one of the second prizes, enter online at contest.thinsations.ca and follow the on screen instructions. When entering online, you will be automatically entered and immediately notified whether or not you are an instant winner. The choosing of an instant winner is computer generated and randomly selected.
3) ELIGIBILITY: This Contest is open to legal residents of Canada, who are the Legal age of majority in the province or territory of which they resides (18 or 19 years of age) as of the Contest Closing Date and who are not professional writers, publishers, copywriters, etc.
Employees of Kraft Canada Inc., and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, (collectively, “Promotion Parties”), and the household members and/or the immediate family of any of the above are not eligible to enter. For the purposes of these contest rules, “immediate family” means husband, wife, spouse, mother, father, brother, sister, son, and/or daughter, whether or not they reside in the same household.
4) POTENTIAL WINNER SELECTION & JUDGING CRITERIA
FIRST PRIZE – TRIP: Eligible entries will be judged by MacLaren Momentum Advertising Agency and the Sponsor. Judging will be based on what the judges feel is the most compelling story entered. Before being declared a Winner, the selected Potential Winner may be required to correctly answer a time-limited mathematical skill-testing question without assistance or mechanical or electronic aid and will be required to sign a standard declaration and release form confirming compliance with the contest Official Rules and acceptance of the prize as awarded. The selected Potential Winner will be notified by phone and/or by e-mail no later than April 18, 2011. If Potential Winner cannot be contacted by April 18, 2011, at Sponsor’s discretion, another Entrant may be selected.
INSTANT WIN PRIZES: If you receive a winning message, you are a selected potential instant winner of the prize indicated. Follow the on-screen instructions to claim your prize. Before being declared a winner, the selected Potential Winner must correctly answer a time-limited mathematical skill-testing question without assistance or mechanical or electronic aid and will be required to sign a standard declaration and release form confirming compliance with the contest Official Rules and acceptance of the prize as awarded. The instant win prizes may vary slightly from the images shown on the contest website including, but not limited to a slight difference in colour, style, model etc as subject to availability.
5) ODDS: The chances of being selected depend upon the number of eligible entries received and the application of the Judging Criteria.
6) PRIZES/APPROXIMATE RETAIL VALUE (ARV): There will be one (1) First Prize and twelve (12) Second Prizes available to be won.
FIRST PRIZE: The first prize is a trip for one (1) winner and a minimum of three (3), maximum of (10) guests. The Trip is to a destination of the winner’s choice within a budget of $25,000.00. The Trip consists of roundtrip, coach class air travel to the destination of the winner’s choice, from the international airport in Canada nearest to the winner’s residence. The Trip duration is a maximum of 7 days and 6 nights in a standard hotel accommodation (one room, double occupancy).
Ground transportation at destination from airport to hotel and return to airport, will be provided. Meals and transportation while in the destination of the winner’s choice are not included. The Trip must be taken and completed by August 21, 2012.
Approximate retail value of this first prize is $25,000.00
The approximate retail value of prize is that stated by the supplier of the prize as being in effect thirty (30) days prior to the launching of this contest.
The winner and their travelling companions must travel on the same itinerary. The winner and their travelling companions will be responsible for all other expenses not specified herein, including but not limited to: travel and medical insurance, ground transportation to and from the international airport in Canada, gratuities, meals, telephone calls, in-room charges, applicable taxes (including Airport Improvement Taxes), incidentals, and any and all other expenses not specified in the description of the Prize. The winner or their travelling companions should have a valid major credit card to present to the hotel upon check-in. Each winner and their travelling companions are responsible for ensuring that all travel papers (passports, visa, etc.) are in good order, and are valid prior to, and for the entire duration of the trip.
If the travelling companion is a minor in the province or territory where they reside, the parent/legal guardian must accompany the minor on the trip and must obtain and be prepared to produce any written consent or consents from the minor’s other parent or legal guardian required by Kraft to permit the minor to travel.
Travel and accommodation arrangements are at the sole discretion of the Sponsor. Absolutely no changes to travel dates or passenger names are permitted once the booking has been made and the Prize winner has submitted the name of the travelling companion and all related booking information to Sponsor. Actual Prize value will depend upon point of departure, travel dates, and airfare fluctuations. Winner is not entitled to monetary difference between actual prize value and stated approximate prize value, if any. If Prize winner elects to travel with no travelling companions, no additional compensations will be awarded. The prize is only as detailed above. No substitutions or transfers of prize by winner permitted. Sponsor reserves the right to substitute prizes of equal or greater value, at its sole discretion.
7) SECOND PRIZES: There will be twelve (12) second prizes available to be won. Three (3) of each of the following prizes:

Nikon COOLPIX S80 with 14.1 mega pixels digital camera in black Model #S80 having an approximate retail value of $349.99
Apple 64gb 4th Generation iPod Touch Model#MC547C/A having an approximate retail value of $429.99
Cisco FLIP Ultra HD 3rd Generation 8gbVideo Camera Model#U32120B in white having an approximate retail value of $219.99
Total approximate retail value of second prizes is (3x $649.99) + (3x $349.99) + (3x $429.99) + (3x$219.99) = $4949.88
Total approximate retail value of first prize and second prizes is $29,949.88
The approximate retail value of each prize is that stated by the supplier of the prize as being in effect thirty (30) days prior to the launching of this contest.
8) DECLARATION AND RELEASE: Potential Winner will be required to execute and return a Declaration and Release within seven (7) days of attempted delivery or prize will be forfeited and may be awarded to an alternate Entrant.
Each travelling companion must execute a Declaration and Release prior to prize award.
The return of any prize/prize notification as undeliverable or noncompliance with the terms of these Official Rules may result in disqualification and at Sponsor’s discretion, selection of an alternate Entrant.
9) LIMITATION OF LIABILITY: By entering this contest, the entrant, accepts and agrees to these Official Rules and the decisions of Sponsor, which shall be final in all matters. By accepting the prize(s), the winner agrees to hold Promotion Parties, their affiliates, directors, officers, employees and assigns harmless against any and all claims and liability arising out of use or redemption of prize or participation in the contest. Promotion Parties are not responsible for lost or late entries or Declaration and Releases, or for any typographical, or other error in the printing of the offer, administration of the contest, or announcement of the prize, or for technical, hardware, or software malfunctions, computer virus, bugs, tampering, unauthorized intervention, fraud, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this contest, or by any human error which may occur in the processing of the entries in this contest, or any other cause beyond the reasonable control of Sponsor that interferes with the proper conduct of the contest as contemplated by these Official Rules. If, in the Sponsor’s opinion, there is any suspected or actual evidence of tampering with any portion of the contest, or if technical difficulties or any other factor including accident, printing, administrative, or any error of any kind compromises the integrity, administration, or conduct of the contest, the Sponsor reserves the right, with consent of the Régie des alcools, des courses et des jeux, to modify, cancel, or suspend this contest without prior notice or obligation. Any attempt to deliberately damage any website or to undermine the legitimate operation of this contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
Sponsor reserves the right to disqualify a person if he/she enters the contest or tries to do so by any means contrary to these rules or which would be unfair to other entrants or where contest entries are generated by any mechanical or automated means. Entry materials that have been tampered with, reproduced, falsified, or altered are void. In the event a dispute arises as to the identity of a potentially winning online entrant, entries made by internet will be declared made by the name on the online entry form.
Currency is in Canadian dollars unless otherwise stipulated. Each prize must be accepted “as is” and may not be exchanged for an amount of money, bartered, sold, raffled, substituted, or transferred, and is non-refundable. In the event the stated prizes is/are unavailable due to reasons beyond the control of Kraft Canada Inc., a prize of equivalent nature and value will be available to be won, or Kraft, in its sole option, may award the winner the equivalent monetary value in lieu of prize. The prize will be delivered only to the confirmed winners.
Refusal to accept a prize releases the Promotion Parties, as well as their respective directors, officers, and employees, of all responsibility and obligations toward the winner of such prize. In no event shall the Sponsor be held to award more prizes that what is mentioned in these rules or to award prizes otherwise than in compliance with these rules.
Promotion Parties shall assume no liability whatsoever for any situation in which their inability to act results from an event or situation unforeseeable or beyond their control, including but not limited to force majeure, a strike, lockout, or any other labour dispute at their location or the locations of the businesses whose services are used to hold this event.
10) LANGUAGE DISCREPANCY: In the event of any discrepancy or inconsistency between the English language version and the French language version of the Contest Rules, as applicable, the English version shall prevail, govern and control.
11) CONDITIONS OF ENTRY: Acceptance of a prize constitutes permission for the Sponsor, and their agencies to use winners’ names, cities and provinces/territories of residence and likenesses for purposes of advertising and publicity in any and all media now or hereafter known throughout the world in perpetuity, without further compensation, notification, or permission, unless prohibited by law.
All information requested by and supplied by each entrant must be truthful, accurate, and in no way misleading. Sponsor reserves the right to disqualify any entrant from the contest in their discretion, should the entrant at any stage supply untruthful, inaccurate, or misleading details and/or information or should the entrant be ineligible for the contest pursuant to these rules.
12) PROVINCE OF QUEBEC: Any litigation respecting the conduct or organization of the contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize in the contest may be submitted to the Régie only for the purpose of helping the parties reach a fair settlement.
13) PRIVACY: Kraft respects entrants' right to privacy. Entrants' names, addresses, telephone numbers, and e-mail addresses are gathered for the purpose of administering this contest and conducting publicity about this contest. By entering the contest, Entrants consent to Kraft's collection, use, and disclosure of their personal information for these purposes.
